Medicine supplier arraigned in court for misappropriation of N2.9m funds

A medicine supplier has been arraigned in court for fraud and misappropriation of funds of over N2.9 million. This man was arraigned in court by the EFCC for his fraudulent activities. It was the Kaduna Zonal Command of the Economic and Financial Crimes Commission, (EFCC), who arraigned this man in court.
This man, who is a medicine supplier, has been identified as Sunday Ekele. His crimes were fraud, misappropriation of funds and criminal breach of trust. The funds he misappropriated was a sum of N2.9m which is N2,930,029 (Two Million Nine Hundred and Thirty Thousand, Twenty Nine Naira) in full.

He was arraigned before the Kaduna State High Court, in a high Court sitting on the 21st of November, 2023 which was last Tuesday. He was arraigned before Justice Darius Khobo. His crimes were on one-count charge which borders on criminal breach of trust and misappropriation.
Sunday Ekele was arrested after a petitioner had alleged that he made an agreement with him to sell some pharmaceutical products which were worth N2,930,029 million. According to the petitioner, Sunday had failed to remit the payment after he supplied the products. He was also unable to recover the products he had supplied after he could get the money.

His charge was read before him and he pleaded not guilty to the crimes. The charge states “That you, Ekele Sunday sometime in January, 2020 in Kaduna within the Kaduna Judicial Division of the High Court being entrusted with property worth N2,930,029 (Two Million Nine Hundred and Thirty Thousand, Twenty Nine Naira only), by one Ayobami Oyeleye for the supply of pharmaceutical products which you sold and dishonestly misappropriated the money to your own use in violation of legal contract which you made in regard to the said sum and you thereby committed an offence contrary to Section 293 of the Penal Code Law of Kaduna State and punishable under Section 293 of the same Law”.

After he pleaded not guilty, the defendant's counsel, Usman Abdullahi, moved for the application of bail for this man however the prosecution counsel, E.K Garba then moved for the application of a trial date he also requested that the defendant be remanded in Kaduna Correctional Centre pending the trial date is fixed.
Justice Khobo listened to both counsels and made the final judgment by granting him bail. He was granted bail in the sum of 2 Million Naira alongside a surety in like sum. They also ordered that this surety must own a property in Kaduna and also have a Certificate of Occupancy that must be verified. The case has been adjourned till the 25th of January, 2024 for hearing.
