Court fixes January 8, 2024 to deliver Godwin Emefiele judgment

The date for Godwin Emefiele’s judgment has been fixed by the court. The court has settled on the 8th of January 2024 to deliver his judgment. A Federal Capital Territory High Court will deliver the judgment in the enforcement of a fundamental rights which was filed by Emefiele. Godwin Emefiele is the former Central Bank of Nigeria Governor. He was arrested for fraud as soon as the new president entered office. He has been in and out of court ever since as his case is still ongoing.

His detention was prolonged and Emefiele then filed for the enforcement of his fundamental human rights. He took the Federal Government, Attorney-General of the Federation, Executive Chairman, Economic and Financial Crimes Commission, and the commission before the court for this reason. He filed for the enforcement of his fundamental rights to life, personal liberty, fair hearing, and freedom of movement.

Emefiele has also sought for a declaration of the court that his prolonged detention since the 10th of June 2023 and the continuous transfer to the custody of the Executive chairman and the EFCC on October 26, 2023, without being arraigned in court is an unlawful act. He then requested that the court order the 4 respondents , which are the Federal Government, Attorney-General of the Federation, Executive Chairman, Economic and Financial Crimes Commission to pay N1bn as damages for violating his fundamental rights. He also asked the court to restrain these 4 respondents from being able to arrest him or detain him anymore after he is released by the court without preferring a criminal charge against him.

The hearing for his case was resumed on Monday. His counsel who is Mathew Burkaa SAN, told the court that Emefiele has been detained for a total of 151 days which is contrary to the law. He requested that the court award damages in favour of Emefiele. He revealed that there is enough basis for the court to enter judgment in Emefiele’s favour. According to him every Nigerian deserves to have protection from the court.

The opposing counsel (the counsel for the first and second respondents) urged the court to dismiss the suit. According to them the suit lacks merit. They claimed that Emefiele was transferred to the custody of EFCC on October 26, 2023 and then the application was filed on the 31st of October 2023. He revealed that Emefiele had no content with the deponent within this period.

On the other hand, the Counsel for the third and fourth respondents urged the court to dismiss the suit as well on the basis that the suit was being misconceived and brought in bad fate. He also supported the claim that Emefiele was brought to the EFCC custody on the 26th of October. He further stated the Godwin Emefiele made some allegations in his originating summons. Emefiele had claimed that the Department of State Service had made some infractions.
Justice Olukayode Adeniyi listened to all the arguments and eventually fixed the 8th of January 2024 for judgment.
